EFFECTIVE DATE May 20, 2025

At Happy Monday, we recognize that maintaining the highest standards of ethics and professionalism is essential to building trust with clients, candidates, and employees. This Professional Code of Ethics forms the basis of our commitment to lawful, fair, and transparent recruitment practices and is aligned with the legal obligations under applicable European Union laws and directives.

We, our clients, and our candidates agree to always strive:

Legal and Ethical Compliance

To fully comply with all applicable European Union and national employment, labour, and data protection laws, including but not limited to the General Data Protection Regulation (GDPR), Directive 2019/1152 on transparent and predictable working conditions, and Directive 2008/104/EC on temporary agency work.

Non-Discrimination and Equal Opportunity

To treat all applicants and employees with dignity and respect and to provide equal opportunities in employment based on objective job qualifications, regardless of race, colour, religion, sex, national or ethnic origin, age, disability, sexual orientation, gender identity, or any other characteristic protected by law.

Transparency and Information Disclosure

To provide workers with written information on their terms and conditions of employment, including their job status (temporary, fixed-term, etc.), wage rate, benefits, hours of work, and nature of assignments, in a clear and understandable format prior to commencement of work, in line with Directive 2019/1152.

Data Protection

To collect, use, store, and share personal data of candidates, clients, and employees only as permitted under GDPR, and to apply appropriate technical and organizational measures to protect such data from unauthorized access, disclosure, or misuse.

Integrity in Recruitment

To maintain high standards of integrity in all advertising and communications, and to recommend only those candidates who are reasonably determined to be appropriately qualified and suited to a client’s needs based on lawful and non-discriminatory assessment criteria.

Skills Development

To encourage and support the professional development of employees and temporary workers by promoting upskilling and training opportunities.

Occupational Safety and Health

To ensure that workers are assigned only to work environments that are safe, that they receive necessary safety training and protective equipment, and that they understand and are capable of safely performing the tasks assigned to them. We are committed to fulfilling our obligations under EU health and safety directives, including Directive 89/391/EEC.

Wage and Social Protections

To pay all wages and benefits on time and in accordance with employment contracts and applicable laws, and to fulfill all employer obligations related to social insurance, taxation, and other statutory requirements.

Grievance and Complaint Handling

To provide a clear, accessible channel for workers to raise concerns about workplace safety, discrimination, harassment, or any other matter affecting their rights or working conditions, and to respond to such concerns promptly and effectively.

Respectful Transitions Between Agencies

To conduct client transitions in an orderly and professional manner. Where feasible, prior notice should be provided to the outgoing staffing firm and its workers. All transitions shall respect existing contractual arrangements and the rights of all affected workers.

Verification of Employment

To confirm, upon request and with the employee’s consent, the details of temporary workers’ employment history and periods of service to subsequent employers or recruitment agencies.

This Code of Ethics is not intended to replace any legally binding agreement between the parties but serves to reinforce shared values and minimum ethical standards applicable to our services across the EU.
